The biggest question that the SC is looking the answer for is can an asset which the telco doesn't own be sold under the IBC process? In the last hearing, Kapil Sibal said that if the SC rules that spectrum is not an asset of the company and therefore the telco can't sell the right to use it under IBC, it would have a negative impact on the economy of the country since no bank would recognise spectrum as a security against the loan and thus would refrain from lending money to the telcos. Along with that, in the last hearing, SC had asked for Bharti Airtel to pay for the uncleared dues of the spectrum that it got from Videocon. Read ahead to find out all the updates from the hearing that took place today. No Additional Dues Demand Raised By DoT Against Airtel and JioJustice Arun Mishra led bench started off by suggesting that the government should cancel the license in case the dues are being wiped out. The apex court questioned how can a party sell something which they don't own. SC said that if the spectrum is traded, then the dues associated to it will be wiped out. This shouldn't happen suggested the apex court. Harish Salve for RCom COC said that the telcos have the authority to sell the right to use of spectrum as per the trading guidelines. According to the license agreement, a spectrum is recognised as a security which can be monetised if need be under IBC. He further said that the liability towards the government is being wiped out because DoT is an operational creditor and not because of the sale of spectrum in the first place. The IBC allows for the sale of the right to use spectrum. Salve also mentioned that it has been verified by DoT that no spectrum trading took place before 2016. The only spectrum trading which took place was with Reliance Jio and it is a small part of the spectrum that RCom owns. Adding to that, no additional dues were demanded by DoT until now from Reliance Jio in respect to this. To this SC observed that it is not fair. It is like selling something you have taken on rent under IBC. The new person to whom the asset is rented won't have to pay anything. That is why, if the spectrum is cancelled, it has to be returned to DoT so that it can be auctioned for a higher amount of money. Ranjit Kumar for Aircel COC said that even if the spectrum is returned to DoT, that won't necessarily mean that any telco would be up for purchasing it. Since the spectrum won't be recognised as a security against the loan, no bank would lend money to the telcos for purchasing the spectrum. Kumar pointed out that the License agreement which has been certified by the President recognises spectrum as security. Telcos don't have the cash reserves to purchase the spectrum in auctions if it were to take place. Kapil Sibal for Airtel said that Videocon entered in the IBC process back in 2018 and the Supreme Court decision on AGR was announced in 2019, then why no demands have been raised for additional dues from DoT until now? Sibal said that Airtel has been paying all the dues for all the spectrum it acquired from Videocon since 2016 and DoT hasn't raised any demand for the dues pertaining to the period before that. Even if the demands are raised by DoT, Airtel reserves the right to challenge the demand in TDSAT so this court should not decide on the matter at this stage said Sibal. SC then asked DoT why hasn't it raised demands for the additional dues? DoT said that once the SC crystallises its view on spectrum sharing and trading, it will take decisions on that basis. Harish Salve for Jio said that only dues which were unknown can be recovered from the buyer and pointed out that AGR dues were known to the telcos. Sibal further questioned that why has DoT waited so long to raise a demand? He said that it was the DoT's responsibility to make everything clear at the time when the spectrum was traded. AGR dues weren't hidden from the telcos and DoT had raised demands, so why wait so long. To this DoT replied that the assessment of part dues of Jio and Airtel for RCom and Videocon are still in process. SC replied that it has been a year since it announced its decision on AGR dues, then why can't DoT make a decision until now? SC has asked DoT to share all the details regarding the demand for additional liability against Jio and Airtel. Reliance Jio today added two new plans to its portfolio of plans with Disney+ Hotstar VIP subscription. The plans in question are Rs 499 and Rs 777. While the newly launched Rs 499 plan is a data pack, the Rs 777 is a combo plan with voice calling benefit also on offer. Furthermore, Jio also brought back the ‘Cricket Dhan Dhana Dhan‘ offer. As part of this offer, Jio is calling the prepaid plans with Disney+ Hotstar VIP membership as ‘Jio Cricket Plans.’ This essentially means that the users recharging these plans can watch the upcoming cricketing season of Indian Premier League (IPL) online on Hotstar for free. Poco seems to be already working on the successor to Poco X2 aka the Poco X3. As spotted on multiple certification sites, the Poco X3 will bear the model number- M2007J20CG. The certification sites have revealed the key specifications of the device like the 64MP camera module on the back, 33W fast charging and also the rear panel design. Right now, it is unknown when Poco is planning to launch the Poco X3. Since the device already received BIS certification, we can expect it to arrive sometime in mid-September. We are not sure whether the Poco X3 is a unique device or just another rebranded Redmi smartphone. Poco X3 Arriving Soon: What to Expect?Tipster Mukul Sharma, in a series of tweets, highlighted the details of an unannounced Poco smartphone, which later on turned out to be the Poco X3. The first tweet from the tipster was revealing the model number of the device- M2007J20CG. In the same tweet, he also stated the phone had received FCC certification and it will also pack a 64MP primary sensor on the back. In the follow-up tweet, Mukul stated that the upcoming Poco smartphone would run MIUI 12 out of the box, and it will have a 5160mAh battery with 33W fast charging support. In addition, the phone also received the Bureau of Indian Standards (BIS) certification. And in the last tweet, he revealed the name of the upcoming Poco smartphone and it is none other than the Poco X3. The name was confirmed by FCC documentation. And the phone also offers support for NFC. Other specifications of the Poco X3 are unknown at the moment. The rear panel design of the handset revealed by FCC is very much identical to that of the Poco X2, so we can expect minor changes on the Poco X3 compared to its predecessor. At a time when all the countries across the world are pushing to introduce wide-scale 5G operations, there are people who still use 3G and 2G. This is the reason why telecom operators have not stopped providing 3G and 2G services in India as well. Vodafone is done with 3G though. The news became official when Ather Energy communicated that they are going to be replacing the Vodafone 3G SIM cards from Ather 450 and replace it with BSNL 3G SIM cards. Vodafone had communicated with the company that they are going to stop their 3G services in Bengaluru and Chennai circle from August 27, 2020. Vodafone Asking Customers to Select 4G as Preferred NetworkTarun, one of the members of the TelecomTalk community forum received a message from Vodafone about the same. Vodafone has been sending SMS to people in Karnataka for upgrading their 3G SIM card to 4G SIM card. The telco is requesting the customers to select 4G as their preferred network type in the network settings of their mobile handset to continue using its services. There is no clarity from Vodafone on how soon it will be removing all its 3G operations within the whole of India but it is not going to take a lot of time now. As for Ather Energy, they were surprised with the move from Vodafone. They said that they knew Vodafone is going to stop 3G services in some time, but they had no clue that this would happen so fast. With this SMS from Vodafone and the statement from Ather Energy, it can be assumed that the telco is going to stop its 3G services in the Karnataka circle on August 27, 2020. Since Ather 450 can't support 4G, they will be swapping the Vodafone SIM cards with the BSNL SIM cards. Thus they will be working out on the swapping procedure now which will take some time. The Ather 450 users can start dropping their vehicles from mid-September to the service centres for the swapping of SIM cards. So until then, all Ather Energy can do is go back to the 2G SIM cards and thus the customers are bound to get a slow experience. ICICI Securities on Sunday said in a report that Vodafone Idea requires more than a 40% tariff hike in the next three years to meet its cash flow needs. The firm said that Vodafone Idea requires a cash flow of Rs 320 billion to service the deferred spectrum equated monthly instalment (EMI) payment, AGR dues, capital expenditure (Capex) and interest on bank borrowings. ICICI Securities said that Vodafone Idea requires its average revenue per user (ARPU) to increase to Rs 79 "to remain a going concern" translating to a 70% increase in APRU. Vodafone Idea Requires Over 40% Hike in Tariff RatesThe firm said that Vodafone Idea will benefit from a rise in 4G users but that it would be "lower than" Bharti Airtel. Further, ICICI Securities said that "a lot of cash burn can be funded from capital infusion" but that Vodafone Idea would still require over 40% hike in tariff in the next three years. The report released by ICICI Securities highlights that Airtel is the firm's preferred "high-conviction" stock in the telecom sector, "notwithstanding the rising risk from AGR liability and sooner than expected 5G rollout." It has to be noted that the adjusted gross revenue (AGR) case is currently being heard in the Supreme Court with most operators requesting a 15 year timeframe for the payment of dues. "Ongoing AGR hearing in SC indicates [a] likely rising risk of liabilities from the spectrum traded from Videocon and Aircel," ICICI Securities said in the report. "Hearing has not concluded and we don't want to take any view." The firm said that Videocon’s AGR liability is 14 billion while Airtel's liability is Rs 124 billion. ICICI Securities said that the "worst case" liability scenario for Bharti Airtel translating to the total due payable by the company will be Rs 138 billion. "However, Bharti has traded only 29% of Aircel spectrum and Aircel bought these spectrums only in FY11 (AGR liability is from FY03), hence assigning the entire liability would be unjustifiable," ICICI Securities said. The firm said that Airtel in the past few quarters showed "significant resilience" and that it was the only telecom operator to "transfer a sizable part of the tariff hike into ARPU." ICICI Securities also reflected on the current stock price of Bharti Airtel which is said to have corrected 12% from its peak levels in May 2020. It was said that the "rising risk of AGR liabilities" played a key part in the price correction of the Airtel stock. The firm said that the current market price of Airtel share price is factoring an ARPU of Rs 165, translating to a 14% increase from the first quarter of the current financial year. ICICI Securities said that Airtel can achieve the ARPU increase "without any tariff hike" by converting its 2G subscribers to 4G. The firm said that conversion of 2G subscribers to 4G would generate 2% to 3% increase in ARPU on a quarter-over-quarter basis. "Our base case assumption ARPU of Rs187 implies a tariff hike of only 15-20%, which we believe is conservative," ICICI Securities said. The firm highlights that the operators recommended five to nine times increase in data prices during the consultations on floor tariff. 5G Not Expected to Become Mainstream SoonICICI Securities said that the 5G rollout in India can happen "sooner," however, the firm doesn't see 5G "becoming mainstream consumer technology soon." The firm said that the 5G ecosystem is evolving and that it is targeted at enterprise use cases. ICICI Securities said that 4G will remain the mainstream consumer technology with 5G being used for "de-clogging network capacity" in places like malls and stadiums. "Operators don't have excess spectrum in 4G to refarm to 5G particularly in low and mid bands and consumer 5G cannot be launched solely on 3,500MHz band (very poor propagation capability)," ICICI Securities said in its report. It was also highlighted that Airtel is already preparing for 5G network integration with its existing network. "We don't see total non-spectrum capex rising significantly as 5G network investment would start when 4G rollout is complete," ICICI Securities said in its report. "Therefore, 5G capex envelope will replace 4G. There would not be significantly higher incremental network capex." Samsung on Monday announced that the One UI 2.5 packed with the features found on the Note 20 series will be rolling out to several Samsung Galaxy devices including the Galaxy S20 series. The company said that the One UI 2.5 features updates to the camera, Notes and Samsung DeX. The One UI 2.5 is also said to include an update that enhances the WiFi connectivity feature on the Galaxy devices along with enhancements to the Reminder app. Samsung said that the One UI 2.5 update has started to roll out to the Galaxy S20 series from August 21, 2020. Samsung One UI 2.5 Update Includes Enhancements to the CameraThe company said that the One UI 2.5 aids users to capture "jaw-dropping footage" with the Pro Video Mode. Samsung said that the users can shoot in 8K with 24fps with an option to record footage in 21:9 aspect ratio. Further, the Pro Video Mode is said to aid users in controlling the mic direction on the smartphone. "When paired with the Galaxy Buds line-up, you can use the earbuds as a pro-style lavalier microphone to minimize background noise and record crystal-clear audio," Samsung said in a release on Monday. Additionally, the One UI 2.5 update is said to include an audio bookmark on the Notes app that enables users to synchronize notes with audio recordings of lectures or meetings. The company said that the users can now pick a section on the notes and play the corresponding audio. With the enhancements to the Notes app, Samsung said that the users can import and write on PDF files making it easier for users to review and revise documents on-the-go. Further, the company said that the autosave and sync feature enables users to access the notes from a Galaxy device, tablet and PC. The One UI 2.5 update is also said to enable users to instantly pair a Galaxy device with the Smart TV wirelessly through Samsung DeX. The users using the Samsung DeX feature can also use their Galaxy device as a touchpad to control the second display. The enhancements to the WiFi connectivity is said to enable users to share the password of the WiFi with nearby Galaxy devices in the user contact list. Samsung One UI Update Will be Available on Over 20 DevicesThe company said that the update will be rolled out to multiple Galaxy devices including Galaxy S20 Ultra 5G, S20 Ultra, S20+ 5G, S20+, S20 5G and the S20. Further, the update will also be rolled out to S10 5G, S10+, S10, S10e, S10 Lite, S9, S9+, Note 10+ 5G, Note 10+, Note 10 5G, Note 10 and the Note 10 Lite. Samsung said that the Note 9, Z Flip 5G, Z Flip, Fold 5G and the Galaxy Fold will also receive the One UI 2.5 update. Bharat Sanchar Nigam Limited (BSNL) is working towards introducing its 4G operations on a wide-scale in India very soon. The telco is known for adding and removing its offerings to the customers on a regular basis. But with that, BSNL also offers a ton of benefits to its existing customers. BSNL discontinued two of its postpaid plans on July 1, 2020. These two postpaid plans were Rs 725 and Rs 149 plans. Plan 149 used to offer customers 500MB of data calling worth Rs 100. As for Plan 725, it used to come with 50GB data every month and offered free voice calling along with 100 SMS per month. Both of these plans are now providing the existing customers after the removal with a discount benefit. Discount Benefit With the Removed Plan 725 and Plan 149The customers who are currently using Plan 725 and Plan 149 stand a chance to get the discount benefit. After 3 months from the removal date of the plan (July 1, 2020) if the customer is still using Plan 149, he/she will be migrated to the Plan 99. There is no automatic migration policy with Plan 725. But there is a discount opportunity with both the plans for the customer. In case the customer leaves his/her Plan 149 and opts for a higher FMC( Fixed Monthly Charge) plan, then they will get a limited period discount benefit of Rs 25 for the next three months on their plans. With Plan 725, if the customer chooses a higher FMC plan, then he/she will get the benefit of Rs 75 discount on their plan for three months. Higher FMC Plans BSNL Customers Can Go forIf the customer wants to go for a higher FMC plan from Plan 149, he/she can choose Plan 225. With this plan, the customer will get the calling benefit of Rs 180 along with the benefit of 100 SMS/day. There is 3GB data offered at high speed which will reduce to 40 Kbps after the consumption. This plan costs Rs 225. For the customer using Plan 725, he/she can go for Plan 799 which costs Rs 799 per month. With this plan, the customer will get 100 SMS/day along with free calling and free I/C calls while roaming as well. The customer gets a data benefit of 60GB per month at high speed, which will be reduced to 40 Kbps once the initial 60GB data is consumed.
